    1. Welcome to “Back To Nature Web Portal” 

     

    PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION ABOUT LIMITATIONS OF LIABILITY AND RESOLUTION OF DISPUTES 

     

    These terms and conditions outline the rules and regulations for the use of Back To Nature ‘s Web Portal, located at http://backtonatureholidays.com. 

    By accessing this website, browsing and/or making a booking, you acknowledge and agree you have read, understood and accepted these terms and conditions including the privacy policy statement. If you do not agree to take all of the terms and conditions stated on this page, you must not use our Information, contact our Customer Support Agents, or make any Bookings.  

    The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.  

     

    1. Definitions 

    In these Terms of Use the following words and expressions shall have the meaning statedAny use of the below terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same. 

     

    “We”, “Our” and “Us”, refers to “Back To Nature Portal”, firm operating a www.backtonatureholidays.com website . 

     

    “Portal”, “Website”, and “Site” means a specially designed website on the internet which can be accessed via PCs or digital devices,  

    Customer”, “Guest”, “Buyer”, “Traveller”, User”, “You”, “Your means individuals or registered members browsing our Information or making Hotel / Accommodation Reservations. 

    “Service Provider”, “Seller”, “Supplier”, “Partner” means the provider of accommodation (hotel, apartment, landlord) and any other accommodation related products or services as from time to time listed and made available for online shopping and accommodation reservations via the Portal.  

    “Reservation” or “Booking” means an online order, purchase, payment or reservation of accommodation.  

    1. Changes to these Terms 

    We may revise these Terms and Conditions at any time by amending this page. We will post revised Terms on the Portal and update the “Last Updated” date on the top of these Terms. 

     Please check this web page each time you make a reservation to take notice of any changes we have made, as they are binding on you in relation to all matters except any reservations made prior to the date of the last set of changes. The Terms that applied at the time you made the reservation will continue to apply to such reservation.    

    1. Privacy and Cookies 

    We care about data privacy and security. Please review our Privacy Policy: http://www.backtonatureholidays.com/privacy policy. By using the site or the Marketplace Offering, you agree to be bound by our Privacy Policy, which is incorporated into these Terms and Conditions.  

    1. User Data 

    We will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site, as well as data relating to use of the site. Although we perform regular routine backup of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.  

    1. Our Service 

    Back To Nature Portal is operating website backtonatureholidays.com, an online platform through which Service Providers can make listings, advertise, market, promote and sell their products and services for reservation, rent, order, purchase, and through which customers and visitors of the platform can search, compare rates and services, make order, reservation, purchase or payment. 

    Back To Nature Portal, as a firm, does not own properties, does not rent or re-sell accommodations, and does not offer any of their own products.  By utilising our web portal to make reservations you are entering into a direct, legally binding, contractual relationship with the Service Provider on whose listing you are making a reservation or purchase a product or service (as applicable). From the point at which you make your Reservation, we act solely as an intermediary between you and the Service Provider. We transmit the relevant details of your Reservation to the relevant Service Provider(s) and send you a confirmation email for and on behalf of the Service Provider. 

    All products listed on our Web Portal are subject to availability. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.  

    1. User Registration  

    You should be a registered member in order to use many of the features of this Web Portal including making reservations and online payments.  You must provide accurate, current, and complete information during registration and keep your account information up to date. You may not register more than one account or transfer your account to someone else. You are responsible and liable for activities conducted through your account and must immediately notify our Customer Support if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.  

    1. Search  

    Search function is available to all visitors of our Web Portal. You can search for Accommodation by using criteria like the type of accommodation, travel destination, travel dates, and number of guests. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria. Relevance considers factors like price, availability, reviews, customer service and cancellation history, popularity, previous trips and saved listings, Service Provider requirements (e.g. minimum or maximum nights), and more. Learn more about search results in our Help Center. 

    Only listings of Accommodation Providers which have commercial agreements with Back to Nature Portal will be made available for search and booking on our Web Portal.  

    1. Reservations 

    Reservation function is only available to users registered at Back To Nature Web Portal. When you book a listed property, you agree to pay all charges for reservation of that property including the listing price, taxes, applicable fees, and any other items identified during the checkout.  When you receive the booking confirmation, a contract for accommodation services is formed directly between you and the Accommodation Provider. Such booking confirmation is a limited licence to enter, occupy, and use Accommodation, on a temporary basis, for a duration as per your booking confirmation. The cancellation policy, late check-in / late check-out, security deposit, and other rules, standards, policies, and requirements identified in the accommodation listing or during check out form part of your contract with the Accommodation Provider.  

    1. Payment and Pre-Payment 

    Add that only online payments are accepted on the Portal. 

    Upon submitting your Accommodation Reservation request, you authorise us to facilitate Accommodation Reservations on your behalf.  

    Service Providers for some of the listed Accommodations offer the opportunity for the bookings to be paid, fully or partially at the same time when reservation is made, by means of secure online payment (to all extent offered and supported by your bank). For certain products and services, Back To Nature Portal facilitates (through third party payment processors) the payment of the relevant product or service (i.e. the payment facilitation service) for and on behalf of the Service Providers.  

    Fully Pre-Paid bookings are paid for by you at the time of making the Reservation. You authorise us to make the Booking for the total reservation price, which includes the Accommodation Reservation rate, displayed by the Accommodation Provider, plus any additional tax recovery charges, taxes, service fees, any applicable taxes on our services and any additional fees separately charged by the Accommodation Provider.  

    Pay Later option may be available at the time of making the Reservation which allows customers to pay at the check-in time, however booking fees as a percentage of the accommodation rate may be required due for payment at the same time when reservation is made. If you select this “pay later” option, the Accommodation Provider will collect the payment due for the Accommodation Reservation in the local currency at the time you use your Reservation.   

    Some Accommodation Providers may require you and/or the Other Persons to present a credit card or cash deposit upon check-in to cover additional expenses incurred during your stay.  Such deposit is unrelated to any payment received by us for your Booking.  

     

    1. Cancellations, Booking Modifications, No-Show, and Refund Policy  

    By making a reservation with a Service Provider, you accept and agree to the relevant cancellation, booking modification, no-show, and refund policies of that Service Provider. The general policies of each Service Provider are made available on our Portal on the Providers detailed information page, during the reservation process and within the confirmation email. In some cases, some bookings, rates, fees or special offers cannot be modified or cancelled after they are processed, and this will be indicated in the cancellation policy of each Service Provider or indicated within the special offer as it may be applicable. In the event of cancellation or no-show applicable city tax and other non-refundable fees may be charged by the Service Provider.  

    If you do not show for the first night of your Booking, but plan to check-in for subsequent nights, you must confirm with the Service Provider no later than the date of the first night of your reservation. Failure to do so may result in your Booking being cancelled and all previous payments will, by default, become non-refundable.  

    Reservations which require down payment (fully or partly) and/or prepayment may be cancelled, without any prior notice, in the event when remaining amounts cannot be collected in full on the due payment date as per the Service Provider’s payment policy and the reservation details.  

    If any Booking (including any associated payment cards) shows signs or is connected to any suspected fraud, abuse or suspicious activity, we or our Service Provider may cancel any Booking. Furthermore, late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and you shall not be entitled to any refund of any (non-refundable) prepaid amount. 

    If you or the holder of any credit card used for payment of a reservation, through our Portal, have conducted any fraudulent activity, we reserve the right to take any necessary legal action and you and/or the card holder may be liable for our and our partners losses, including litigation costs and damages.  

    Eligible refunds are processed immediately however they usually take several days to reflect on the original payment method. (Refund part should be completed after the input from the bank is received) 

     

    Force Majeure Policy  

    Force Majeure Policy governs cancellations under unforeseeable events or circumstance, which are beyond guests’ control, which arise after booking and make it impracticable or illegal to complete the reservation. Guests impacted with such events are entitled to cancel their reservations and receive a refund. The following events may be eligible for cancellation under the Force Majeure Policy: 

    Travel requirements changes imposed by government – Unforeseen and unexpected changes to visa requirements by a government agency that may prevent completion of reservation for a given listing location. This does not include any personal circumstances such as lost, stolen or expired documents.  

    Travel restrictions imposed by government – Circumstances under which travel restrictions arise and are imposed by the government whether prohibiting traveling to, staying at, or returning from the listing location. This does not include non-binding and unsolicited travel advisories and similar guidance. 

    Declared emergencies and epidemics – Circumstances under which government declared local or national or international emergencies due to natural disasters, pandemics, epidemics, and public health emergencies. This does not include natural disasters that endemic or commonly associated with an area. 

    Hostilities – War, military actions, hostilities, invasion, act of foreign enemies, rebellion, terrorism, revolution, insurrection, military or usurped power, civil war, 

    riot, commotion, civil disorder, bombings, and explosions.  

    Acts of God – Natural catastrophes such as earthquake, hurricane, typhoon or volcanic activity, and other severe and abnormal weather conditions. This does not include any natural or weather conditions that are common enough to be foreseeable in that location.  

    1. User Generated Contributions  

    The Site may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, “Contributions”). Contributions may be viewable by other users of the Site and the Marketplace Offerings and through third-party websites. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:  

    1. The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret or moral rights of any third party.  
    1. You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorise us, the Site, and other users of the Site to use your contributions in any manner contemplated by the Site and these Terms of Use.  
    1. You have the written consent, release, and/or permission of each and every identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Site and these Terms of Use.  
    1. Your Contributions are not false, inaccurate, or misleading.  
    1. Your Contributions are not unsolicited or unauthorised advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailing, or other forms of solicitation.  
    1. Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libellous, slanderous, or otherwise objectionable (as determined by us).  
    1. Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.  
    1. Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people.  
    1. Your Contributions do not violate any applicable law, regulation, or rule. 
    1. Your Contributions do not violate the privacy or publicity rights of any third party.  
    1. Your Contributions do not contain any material that solicits personal information from anyone under the age 18 or exploits people under the age of 18 in a sexual or violent manner.  
    1. Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors. 
    1. Your Contributions do not include any offensive comments that are connected to race, religion, national origin, gender, sexual performance, or physical handicap.  
    1. Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms and Conditions, or any applicable law of regulation.  

    Any use of the Site or the Marketplace Offerings in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site and the Marketplace Offerings.  

     

    1. Contribution License 

    By posting your Contributions to any part of the Site, you automatically grant and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorise sublicenses of the foregoing. The use and distribution may occur in any media formats and through any media channels.  

     

    This license will apply to any form, media, or technology now known or hereafter developed, and includes or use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.  

    We do not assert any ownership over your Contributions. You retain full ownership of all full ownership of all of your contributions and any intellectual property rights, or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area of the Site. You are solely responsible for your Contributions to the Site, and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.  

     

    We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change and Contributions; (2) to re-categorize and Contributions to place them in more appropriate locations on the Site; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.  

    1. Guidelines for Reviews  

    We may provide you areas on the Site to leave reviews and ratings. When posting a review, you must comply with the following criteria: (1) you should have first-hand experience with the person/entity being reviewed; (2) your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language; (3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability; (4) your reviews should not contain references to illegal activity; (5) you should not be affiliated with competitor if posting negative reviews; (6) you should not make any conclusions as to the legality of conduct; (7) you may not post any false or misleading statements; and (8) you may not organize a campaign encouraging others to post reviews, whether positive or negative.  

    We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views on any of our affiliates or partners. We do not assume liability for ant review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully paid, assignable and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.  

    1. Disclaimer 

    The Site is provided on an as-is and as-available basis. You agree that your use of the site services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Site and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  

    The information available and disclosed within our listings is based on information provided to us by Service Providers. Service Providers are fully responsible for keeping their listing up to date including rates/fees/prices, availability, policies, Terms & Conditions and other relevant information which is displayed on our Web Portal and related to their property. Although we will use reasonable skill and care in providing our service of linking Service Providers and Users to make deals, we make no warranties or representations about the accuracy or completeness of the site’s content or the content of any websites linked to this site and we will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the site, (3) any unauthorised access to or use of our secure services and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the site, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the site by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the site. We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and will not be a party to or in any way be responsible for monitoring and transaction between you and any third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgement and exercise caution where appropriate.  

     

    1. Intellectual Property Rights 

    Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website design, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. The content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.  

     

    Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.  

     

    1. Governing Law 

    These terms shall be governed by and defined following the laws of the United Arab Emirates. Back To Nature Portal and yourself irrevocably consent that the courts of the United Arab Emirates shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.  

     

    1. Dispute Resolution 
    • Informal Negotiations 

    To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Use (each a “Dispute” and collectively, the “Disputes”) brought by either you or us (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least ninety (90) days begore initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.  

     

    • Binding Arbitration  

    Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the International Commercial Arbitration Court under the European Arbitration Chamber (Belgium, Brussels, Avenue Louise, 146) according to the Rules of this ICAC, which is a result of referring to it, is considered as the part of this clause. The number of arbitrators shall be one (1). The seat, or legal place, or arbitration shall be Dubai, United Arab Emirates. The language of the proceedings shall be English. The governing law of the contract shall be substantive law of the United Arab Emirates.  

     

    • Restrictions 

    The Parties agree that any arbitration shall be limited to the Dispute between Parties individually. The full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.  

      

    • Exceptions to Informal Negotiations and Arbitration 

    The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) and Dispute related to, or arising from, allegations of theft, privacy, invasion of privacy, or unauthorised use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.  

     

    1. Corrections  

    There may be information on the Site that contains typographical errors, inaccuracies, or omissions that may relate to the Marketplace Offerings, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.
